Please read these terms and any other terms of use posted on the Site as collectively constituting the Site’s terms governing your use of it and its services (including the call center and mobile app of the Site). We may change these Site Terms from time to time without notice to you by posting updated Terms on the Site, so please check regularly for updates. By registering for any order placed on our website, you agree to the latest version of the website’s terms. If any change in the law means that we have to change the terms of our website after you have placed your order – but before you implement it – we are committed to applying that change to your order. In all other cases, the published version will be applied at the time of your order registration, and if you do not agree to be bound by the terms of the site, you should not use it.

Eligibility

We aim to make the site and its related services accessible to as many users as possible. However, we require you to be at least 18 years of age and have the ability to do the following legally: (i) payment through one of our accepted payment methods; on the site. In addition, orders placed on the UAE website must contain addresses within the UAE only and not outside. Please refer to the delivery section below. The Site is for your personal use or for gifts only and is not permitted for commercial use. We reserve the right to refuse applications that we suspect are for commercial use.

Registration

To benefit from the benefits and services of this website, you can either use the site (or the site’s call center) with visitor data or create an account and register your data with us. If you are a member of Facebook, you can also log in using your Facebook profile. You are always responsible for ensuring that any personal or payment data you provide to Elaine is correct and complete. Please keep your account and password confidential. Our customer service representatives will never ask you for your password. We are committed to complying with our Privacy Policy, but we are not responsible for any loss suffered by any customer due to misuse of such data. Please notify us as soon as possible if you believe that your personal account on our site has been compromised. By registering for any order placed on the Site, you are committed to meeting the eligibility criteria described above and you confirm that the information you have provided is your information and is accurate in all respects. Commercial entities are not eligible to register with us.

Privacy and Cookie Policy

Please refer to our Privacy and Cookie Policy for details on how we treat your data Applications Purchase orders are subject to our acceptance, which we may withhold at our discretion for reasons such as ineligibility, inability to confirm payment authorization, suspected fraud, shipping restrictions and stock availability. The site (or our call center) may display information regarding the availability of products, and this information can be used to estimate the likelihood of a product being available once the order is placed. Unfortunately, we cannot guarantee that any product listed as available will be immediately available, as the available stock of products can change dramatically throughout the day. In rare cases, the product may be available at the time you place an order, but by the time the order is placed, the available stock is fully sold. If this happens you will be notified. You will be notified of your receipt by email. However, the order will only be confirmed when you receive an email from us confirming that the product (s) have been sent for delivery. No other party has the authority to confirm the acceptance of an order. Once confirmed, the application is deemed to have been concluded in Dubai, United Arab Emirates.

Paying Off

We currently accept the following payment methods for orders placed on our website: Visa, MasterCard, PayPal. The Cash on Delivery option is available for orders up to a maximum of AED 20,000. The amount due will be collected at the time of placing your order and by entering your payment information on our website. You warrant that you have obtained permission to pay using that data. We reserve the right to refuse orders without any obligation to you where we believe the payment is not authorized, the payment method is invalid or where we believe you are not authorized to use the payment method used.

The Prices

Prices are displayed in UAE Dirhams, excluding any services that you may choose to associate with the purchase. Delivery charges, taxes or customs duties that may be subject to the purchase. Any such additional costs will appear to you before the last order steps.

When you pay for your order using a payment card in a currency other than AED, the amount paid will be converted to AED at the exchange rate applicable from the card issuer at the time of payment.

Delivery fees, taxes and customs duties (if applicable) will be determined by the destination to be delivered, the products and services selected and the delivery method. Please refer to the Delivery section for more details on delivery options.

Although we have made every effort to ensure that the prices displayed on our site and our sources of information are correct, there may be an error. If any error occurs and your request has already been processed, then at our discretion we may:

• Cancellation of the order (or part thereof), agreement with you to return the product (s) that appeared at a price other than its real price by mistake and will be received from the original delivery address for that order within the UAE, and return the full amount paid to you; including delivery charges , Taxes and customs fees (if any) for the original order.
• When the price paid is lower than the real price of the product, you will be reviewed by our customer service to clarify the order to process the order.
• When the price paid is higher than the actual price of the product, then we will notify you as soon as possible and we will not process the order (or any part thereof) until after you confirm your agreement to purchase at the correct price, or otherwise cancel the order (or part thereof) and return the amount paid Fully to you.

Vouchers & Discount Programs

Vouchers are only valid for use on their terms and up to the specified date, can only be used once, cannot be redeemed for cash and cannot be used with any discounts, discounts or other promotions. Vouchers are for the individual only and cannot be given to others. Internal Circle discounts are not currently available for orders placed through the site.

Delivery & Delivery Options

Currently delivery to addresses in UAE only. Below are the ways of delivering orders that are currently available. However, we always strive to improve our customer experience and may offer additional ways to deliver or receive through our marketing channels. Please check back frequently to see if other options are available. If your order is damaged or any of the products is different from your order, please agree to return the product to a sales department. The product must be replaced in the same condition it was received within 6 days of receiving the order. Damaged products may also have a warranty against manufacturing defects to be replaced by the same product only and may not be replaced by any other product.

Manufacturing Defects

The product will be replaced within 2 days

• If a defect is discovered in the product, it must be reported within a maximum period of 24 hours from the receipt of the product, otherwise the company is not responsible for the existence of any defects.
• The company does not guarantee breakage or damage resulting from misuse.
• The requested order can also be canceled as long as the request is not processed by calling our customer service (600502008).

Product Liability

By placing your order through our website, you acknowledge and agree that all responsibility for the products lies with the manufacturer, and that we are not ultimately responsible for those products, except as described in the return section regarding the return and refund of the products in accordance with the company’s policies.

Product Ownership

The ownership of the products in your order will be transferred to you after one of the following days: (i) the day you paid the full price of those products; or (ii) the day you received the products. The responsibility for the products is transferred upon delivery to you at the delivery address mentioned in the order.

Intellectual Property Rights

Your use of the Website and its contents does not grant you any copyrights, copyright, design, trademark or other intellectual property rights relating to the Content (as described in the content section below), including our software or information written in the Hypertext Markup Language (Shmoukh), Another code on the site. All such content, including trademarks of third parties, designs and related intellectual property rights mentioned or displayed on this website are usually protected by national and international IP protection laws and treaties.
